These terms describe the rules for using Gather to create events, upload photos, manage releases and share galleries.

Acceptance

By accessing or using Gather, you agree to these terms. If you use Gather on behalf of an organization, you confirm that you have authority to accept these terms for that organization.

If you do not agree to these terms, do not use the service or upload content to an event gallery.

The Service

Gather lets event organizers create event galleries, invite contributors, receive photo uploads, manage release information, review content and publish unlisted galleries for viewing and downloading.

We may change, suspend or discontinue parts of the service as needed to maintain, improve or protect Gather.

Accounts and Access

  • You are responsible for keeping your account credentials secure and for activity under your account.
  • You must provide accurate account and event information and keep it reasonably up to date.
  • You may not access another user account, event dashboard or private gallery without permission.
  • We may restrict or disable access if we believe an account or event is being misused.

Event Content

You keep ownership of photos and other content you upload. By uploading content, you give Gather the rights needed to host, store, process, display, moderate, publish, download, back up and transmit that content as part of operating the service.

If you upload content to an event, you also allow the event organizer to review, publish, unpublish, download and manage that content for the event.

Your Responsibilities

  • Upload only photos and information that you have the right to provide.
  • Obtain permissions, consents and releases required for people, venues, artwork, brands or other protected material shown in uploaded content.
  • Do not upload unlawful, harmful, abusive, infringing, private or exploitative content.
  • Do not attempt to bypass access controls, disrupt the service, scrape private content or reverse engineer non-public parts of Gather.
  • Comply with laws that apply to your events, uploads, downloads and publication decisions.

Organizer Responsibilities

Event organizers are responsible for their event settings, invitations, publication decisions, release requirements and use of downloaded photos. Organizers must make sure they have the rights and permissions needed to collect, publish and use event content.

Third-Party Services

Gather may rely on third-party providers for authentication, hosting, storage, database services, email, analytics and error reporting. Their services may be governed by their own terms and privacy notices.

Intellectual Property

Gather, including its software, design, branding and product features, is owned by the operator of the service and its licensors. These terms do not grant you rights to Gather trademarks, source code or other intellectual property except as needed to use the service.

Disclaimers

Gather is provided as is and as available. We do not promise that the service will be uninterrupted, error-free, fully secure or that every uploaded file will always be available. You are responsible for keeping independent copies of important photos and records.

Limitation of Liability

To the fullest extent permitted by law, Gather and its operators will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or business opportunities arising from your use of the service.

Termination

You may stop using Gather at any time. We may suspend or terminate access, remove content or unpublish galleries if we believe these terms have been violated, if required by law or if continued access creates risk for Gather, users or others.

Changes to These Terms

We may update these terms as the service changes. The updated version will be posted on this page with a new last updated date. Continued use of Gather after updates means you accept the revised terms.
